A man who faced felony menacing charges recently pleaded guilty to misdemeanor charges of obstructing an officer. The man's felony charges were dropped as part of a plea agreement "drawn out of equity," one prosecutor said. The prosecutor went on to say that the man suffered "a tremendous consequence" for his actions.
The tremendous consequence was a Fort Collins police officer shooting the man after the man apparently brandished a plastic toy gun. Although the gun was not real, it would have been easy for the prosecution to claim that the officer involved in the shooting was placed in fear of his life. This plea agreement allows the man to avoid a felony offense and put this situation behind him.
In addition to being shot by the officer, the man also suffered an infection of his bullet wound. His medical condition appeared to worsen as he pled guilty to his misdemeanor charges. The man actually collapsed in court but finished giving his guilty plea on the floor.
The man will serve probation and undergo a mental health evaluation as part of his plea agreement. It is unclear whether the man suffers from a mental condition. The man exhibited odd behavior on the evening he was confronted by an officer. The man had reportedly been involved in a knife fight that night and was found covered in blood. He was shot by the officer after he allegedly threw a plastic fireman's hat at the officer and then reached for the toy gun.
